Storage Terms and Conditions

These terms apply when you ask DK Engineering (Storage Services) Ltd ("DKE") to store your vehicle. If you are a consumer, your statutory rights remain unaffected.

1. Definitions

DKE – DK Engineering (Storage Services) Ltd.

Client – The person or company storing a vehicle with DKE.

Vehicle – Any vehicle listed on the storage agreement.

Storage – Vehicle storage and related handling services provided by DKE.

Price – The agreed storage charges and any applicable insurance costs.

2. Ownership & Responsibility

You confirm that you own the vehicle or have authority from the owner to place it into storage.

You are responsible for any incorrect information provided to DKE.

You agree to indemnify DKE against claims arising from the vehicle or information supplied by you.

3. Payments

Storage fees are invoiced quarterly in advance.

Invoices must be paid within 14 days.

Late payments may incur interest at 5% above the Bank of England base rate.

DKE may refuse storage or release of a vehicle until outstanding balances are paid.

4. DKE's Right of Lien

If payment remains outstanding, DKE may retain possession of the vehicle and, if necessary, sell it to recover unpaid charges and costs. Any remaining balance from the sale will be returned to the owner.

5. Collection of Vehicles

Please provide at least 48 hours' notice before collecting your vehicle.

All outstanding charges must be cleared before release.

If fees remain unpaid or a vehicle is not collected when requested, DKE may exercise its rights under Section 4 after giving 14 days' notice.

6. Insurance

You must maintain fully comprehensive insurance covering the vehicle's full value whilst in storage.

Your insurer must be informed that the vehicle is stored with DKE.

DKE requires a subrogation waiver from your insurer.

If a waiver is not provided, DKE may refuse storage or arrange insurance at your expense.

7. Loss or Damage

DKE is not responsible for accidental loss, damage, destruction, or injury caused by the vehicle whilst in storage, except where liability cannot legally be excluded.

8. Vehicle Condition

A condition report will be completed when the vehicle enters storage.

This report will be considered the official record of the vehicle's condition.

A further inspection will take place when the vehicle leaves storage.

Damage claims must be reported at collection and confirmed in writing within 48 hours.

Claims for a missing vehicle must be made within 7 days.

9. DKE Liability

DKE is only liable for foreseeable losses directly caused by its negligence.

DKE is not responsible for mechanical faults that occur whilst a vehicle is in storage unless caused by DKE's negligence.

DKE's maximum liability is limited to £100,000 or the proven loss, whichever is lower.

Nothing limits liability for death, personal injury caused by negligence, or fraud.

10. Changes to Terms or Pricing

DKE may update storage prices or these terms by providing at least 21 days' notice.

11. Use of Third Parties

DKE may use trusted contractors or third parties to help fulfil its storage obligations.

12. Termination

Either party may terminate the storage agreement by giving 7 days' written notice.

Storage fees remain payable for the contracted period.

DKE may require vehicle removal if financial concerns arise or if continued storage may damage the vehicle.

13. Force Majeure

DKE is not responsible for delays or failures caused by events beyond its reasonable control, including fire, extreme weather, industrial disputes, or similar circumstances.

14. General

The storage agreement represents the entire agreement between DKE and the Client.

If part of these terms is found invalid, the remainder will continue to apply.

Any relaxation of these terms by DKE does not waive its rights.

15. Notices

All notices must be provided in writing. Notices to DKE should be sent to:

16. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
